Party Wall Agreement

The Party Wall Act covers three distinct types of work, alterations, remedial works to a shared Party Wall or Party Fence wall, the construction of new walls on the boundary and excavation work to a level deeper than your neighbour’s foundations will also constitute a Party Wall matter if they are within 3 metres (or in some cases 6 metres) of the Party Wall or Party Structure.

All semi-detached and terraced houses have Party Walls, flats have Party Structures. A Party Wall or Structure separates you and your neighbour’s property.

Where work falls within the scope of the Act it is necessary for a Building Owner to serve notice and obtain the affected Adjoining Owner’s consent; if that consent is not forthcoming the parties are deemed to be ‘in dispute’ under the Act and Party Wall surveyors must be appointed so that the dispute can be resolved by way of a Party Wall Agreement

Structural Calculations

From time to time your home extension or loft conversion may require structural calculations to realise your design. Any structural alteration made to residential or commercial buildings, whether its a small extension or removal of an internal load bearing wall, needs Building Control approval. Structural calculations should be carried out to demonstrate compliance to the Local Authority and to advise builders.

 

Tree Survey

If you are applying for planning permission, and trees are present a tree survey will generally be requested by the local planning authority. The reason for this is to assess whether construction activity is likely to have an unacceptable impact on nearby trees. The local planning authority will generally stipulate that for this a tree survey for planning purposes must be undertaken in accordance with the British Standard for tree surveys and development.

A Tree Protection Plan must be drawn up showing how the retained trees will be protected throughout the construction phase. The position of protective fencing barriers will be shown on the Tree Protection Plan, together with the location of any ground protection measures. The Tree Protection Plan should form part of the Tree Protection Measures, which detail how the protective fencing should be constructed.

Building Regulation Application

The building regulation drawings, along with any other relevant information such as the structural calculations, will need to be submitted for building regulation approval.

Tailored Plans will submit the application for you and will liaise with the building inspector to gain approval of the works.  The building regulation approval is often conditional, meaning that it is approved subject to any outstanding information being submitted for approval when available.

A conditional approval often relates to manufacturer’s information which isn’t available until work starts on site, e.g. details of the chosen roof tile to ensure that it is suitable for the pitch of the extension roof.
